Over the years, Paul Maloof has gained broad experience in representing both debtors and creditors in situations where negotiation or litigation has been required.
Debtors
In 1977 the U.S. Congress established the Fair Debt Collection Practices Act to protect the debtor from certain practices by collectors. The Act has been amended over the years to address new forms of debt as well as changes in the conduct of collectors.
Many are not aware that harassing phone calls, badgering, and other confrontational tactics are prohibited by this Act and the debtor has rights.
Paul Maloof has focused a portion of his practice on this Act and its impact on his clients. Whether you are wondering about your rights in a given situation or your account has already gone to court, he can provide you with a full understanding of your rights and how the Act applies. He can also represent you in negotiating a fair and proper payment plan.
Creditors
Collection laws differ from state to state; so do the rights, responsibilities and restraints placed on creditors. The complicated process of collecting a debt may involve anything from a “dunning letter” to a lawsuit.
In order to provide a satisfactory resolution to non-payment, companies and businesses have called upon Paul Maloof to guide them through the process.
Waiver of Subrogation
Personal or business losses can happen through negligence. When this happens, the negligent party is generally held responsible.
Sometimes an insurance company, which covers the loss, may sue a third party to recover the claim. This is called subrogation.
Some contracts include a waiver for subrogation as a part of risk management. Before executing or entering into any such agreement, a lawyer familiar with such issues should be involved in the process. Paul Maloof is able to easily navigate these issues with his clients.
Garnishment of Wages or Bank Accounts
Wage or account garnishment is a legal procedure for the payment of debts such as civil judgments, child support, alimony, or other money judgments.
If your wages are being garnished or you need to garnish someone’s wages, Paul Maloof can assist you in a proper course of action.
Foreign Judgments
Often a judgment has to be domesticated in the state or county where the debtor either resides, is employed or has assets. In either case, these are considered foreign judgments.
Paul Maloof is available where there is a need for the domestication together with an execution on the foreign judgment in Virginia, Maryland and the District of Columbia.
International judgments, which are based on reciprocity agreements or treaties, are easily handled due to Mr. Maloof’s proximity to Washington D.C. as well as his familiarity with such procedures in these courts.
